Abstract
La eficacia de los sistemas de gestión lleva a medir periódicamente la aplicación de la
normatividad y aplicar lo mencionado en el Código Civil colombiano en su artículo 9 (Senado de
Colombia, 1873), aunado a la jurisprudencia del Estado Colombiano como la sentencia C651/97, donde se señala: “que el desconocimiento o ignorancia de la ley no es óbice para cumplir
con lo que se establece a través de la norma”.
Por ende, este documento constituye la sistematización de la información asociada al
cumplimiento del Sistema de Gestión de Seguridad y Salud en el Trabajo (SG-SST) en los
establecimientos hoteleros (hoteles, hostales) del casco urbano del municipio de Mitú, conforme
lo establece la Resolución 0312 de 2019, cuyos empleadores o contratantes cuenten con diez (10)
o menos trabajadores y que estén clasificados con riesgos tipo I, II y III.
Es indispensable encontrar la línea base para que estos establecimientos hoteleros del
casco urbano de Mitú inicien, complementen o maduren la implementación progresiva de sus
Sistemas de Gestión de Seguridad y Salud en el Trabajo; a fin de diagnosticar en primera
instancia su alineación con la norma e identificar los vacíos o hallazgos para que de esta manera
se tomen las medidas correctivas pertinentes para salvaguardar la seguridad y la salud de sus
trabajadores; favoreciendo el uso de mecanismos que contribuyan a la divulgación y
socialización del contenido normativo, permitiendo el aumento en eficacia e impacto de la
misma.
The effectiveness of management systems requires periodically measuring the application of regulations and ensuring adherence to the Colombian Civil Code, specifically article 9 (Senate of Colombia, 1873), along with relevant Colombian jurisprudence, such as sentence C-651/97, where it is stated: “that lack of knowledge or ignorance of the law is not an obstacle to complying with what is established through the norm.” Therefore, this document constitutes the systematization of information associated with compliance with the Occupational Health and Safety Management System (SG-SST) in hotel establishments (hotels, hostels) within the urban area of the municipality of Mitú. This applies to establishments with employer or contractors who have ten (10) or fewer worker and are classified wit type I, II or III risks, as established in Resolution 0312:2019. Establishing a baseline for these hotel establishments in the urban area of Mitú is crucial. This allow for the initiation, completion, or further development of their Occupational Health and Safety Management Systems; in order to diagnose in the first instance its alignment with the standard and identify the gaps or non-conformities found so that the pertinent corrective measures can be taken to safeguard the safety and health of its workers; favoring the use of mechanisms that contribute to the dissemination and socialization of regulatory content, allowing an increase in its effectiveness and impact.
