Abstract
Este trabajo de grado describe y analiza de manera amplia, los procesos de aplicación de leyes insolvencia en Colombia y en especial y el de la empresa S&S Ingeniería Eléctrica S.A.S que por cuestiones negativas en sus estados financieros solicita entrar en un proceso de reorganización ante la superentendía de industria y comercio como ente garante de que se tengan unos acuerdos acordes a las leyes establecidas para ello se toma en cuenta los mecanismos actuales como es la ley 1116 de 2006. Como objetivo general del trabajo de grado Analizar la aplicabilidad de la ley 1116 del 2006, régimen de insolvencia empresarial para la reorganización financiera en la empresa S&S Ingeniería Eléctrica SAS, con el fin de evaluar la liquidez financiera en la toma decisiones, mediante el análisis de la normatividad legal. La metodología empleada para el desarrollo de los objetivos específicos se utilizo un enfoque mixto debido a que se describen datos no estandarizados en cuanto a proceso cualitativos y datos estadísticos para resultados matemáticos con referencia a los estados financieros. El tipo de investigación fue el descriptivo, ya que la problemática objeto de estudio pretende que los datos pueden medirse a lo largo del tiempo determinar las condiciones prevalecientes y concluir un análisis a profundidad. Como resultado final a modo de conclusión se observó y describió que los procesos de reorganización son de buen beneficio para las organizaciones, siempre y cuando estas cumplan con los acuerdos establecidos en los procesos de reorganización aunque se presentan situaciones que limitan a la empresa como es la obtención de créditos por un tiempo determinado mientras dura todo este proceso para S&S Ingeniería Eléctrica SAS el análisis realizado en la aplicación para medir los efectos va por buen camino y a la fecha los estado financieros muestran número positivos y cumplimiento de sus obligaciones.
This thesis work describes and analyzes extensively, the processes of enforcement of insolvency laws in Colombia and in particular that of the company S&S Ingeniería Eléctrica S.A.S that for negative reasons in its financial statements requests to enter into a process of reorganization before the super-industry and trade agreement as a guarantee that agreements are had in accordance with the laws established for this purpose, the current mechanisms such as Law 1116 of 2006 are taken into account. As a general objective of the undergraduate work Analyze the applicability of Law 1116 of 2006, business insolvency regime for financial reorganization in the company S&S Ingeniería Eléctrica SAS, inorder to evaluate financial liquidity indecision-making, by analyzing legal regulations. The methodology used for the development of specific objectives was used a mixed approach because it describes non-standardized data in terms of qualitative process and statistical data for mathematical results with reference to financial statements. The type of research was descriptive, as the problem under study suggests that data can be measured over time to determine prevailing conditions and conclude an in-depth analysis.
