Abstract
La regulación de las criptomonedas en Colombia es un tema que ha cobrado gran relevancia por su influencia en aspectos legales, económicos y tecnológicos. En el presente trabajo se discuten las medidas regulatorias presentadas y estudiadas en relación con las criptomonedas y cómo estas afectan la economía y el ecosistema financiero del país, teniendo como divisa más representativa el Bitcoin. Por su influencia en los mercados ha generado la necesidad de establecer un marco regulatorio en varios países del mundo, por lo que se hace un acercamiento a las criptomonedas y la tecnología Blockchain que las hizo posible. Se estudia la posición del gobierno colombiano en los últimos años frente al mercado de criptomonedas y el cambio que ha promovido en la economía, lo que ha puesto en marcha estudiospilotos e investigación para el desarrollo de normas tributarias y proyectos de ley que se analizan de forma crítica por parte del grupo de investigación dando las regulaciones y pronunciamientos emitidos por las entidades como la superintendencia financiera y la DIAN y se exploran las implicaciones tributarias y legales que los tenedores deben considerar en Colombia. Se presentan aspectos como la inversión en tecnología blockchain, el fomento de la innovación financiera y las oportunidades para la inclusión financiera de poblaciones no bancarizadas. Se estudian los desafíos que enfrenta Colombia al regular las criptomonedas, los riesgos y la necesidad de mantener un equilibrio.
The regulation of cryptocurrencies in Colombia is a topic that has gained significant importance due to its influence on legal, economic, and technological aspects. In the present work, the regulatory measures presented and studied in relation to cryptocurrencies are discussed, along with how they impact the economy and the country's financial ecosystem, with Bitcoin being the most representative currency due to its market influence, which has prompted the need to establish a regulatory framework in various countries around the world. Therefore, an approach to cryptocurrencies and the enabling Blockchain technology is undertaken. The position of the Colombian government in recent years regarding the cryptocurrency market and the changes it has instigated in the economy are studied. This has initiated studies, pilots, and research for the development of tax regulations and legislative projects that are critically analyzed by the research group, taking into account regulations and statements issued by entities such as the Financial Superintendence and the Tax Authority (DIAN). The tax and legal implications that holders must consider in Colombia are explored. Aspects such as investment in blockchain technology, the promotion of financial innovation, and opportunities for financial inclusion of unbanked populations are presented. The challenges that Colombia faces in regulating cryptocurrencies, the risks involved, and the need to maintain a balance are examined.
