Abstract
El presente trabajo de investigación aborda el acoso sexual en los ambientes laborales
como una amenaza directa a la seguridad y salud en el trabajo (SST), entendiendo esta
problemática no solo como una vulneración a los derechos humanos, sino como un riesgo
psicosocial que afecta la dignidad, integridad y bienestar emocional de los trabajadores. Desde
una perspectiva jurídica, se analizan las normas y fallos jurisprudenciales colombianos más
relevantes, junto con los avances internacionales impulsados por la Organización Internacional
del Trabajo (OIT) y el Convenio 190, que promueven entornos laborales libres de violencia y
discriminación.
La investigación, de enfoque cualitativo, documental y jurídico-dogmático, utiliza un
método inductivo que permite interpretar el marco normativo y las decisiones judiciales en torno
al acoso sexual laboral.
Como resultado, se diseña un Manual de Gestión de Casos de Acoso Sexual Laboral
dirigido a empleados y empleadores, que establece directrices claras sobre prevención, denuncia,
investigación y sanción, garantizando procedimientos accesibles, confidenciales y con enfoque
de género. Este manual se convierte en una herramienta de apoyo para fortalecer la cultura
organizacional, promover ambientes laborales seguros y reafirmar el compromiso institucional
con el respeto, la equidad y la salud laboral integral.
This research project addresses sexual harassment in workplace environments as a direct threat to occupational safety and health (OSH), understanding this issue not only as a violation of human rights but also as a psychosocial risk that affects workers’ dignity, integrity, and emotional well-being. From a legal perspective, the study analyzes the most relevant Colombian regulations and jurisprudence, along with international advances promoted by the International Labour Organization (ILO) and Convention No. 190, which advocate for workplaces free from violence and discrimination. The research follows a qualitative, documentary, and legal-dogmatic approach, using an inductive method to interpret the legal framework and judicial decisions regarding workplace sexual harassment. As a result, a Manual for the Management of Workplace Sexual Harassment Cases was designed for both employees and employers. This manual establishes clear guidelines for prevention, reporting, investigation, and sanction processes, ensuring accessible and confidential procedures with a gender perspective. It serves as a practical tool to strengthen organizational culture, promote safe and respectful workplaces, and reinforce institutional commitment to equity, respect, and comprehensive occupational health.
