dc.description.abstractPower and law are two sides of the same coin, which validly exists, if it has been built in a legitimate and legal manner. Within this framework, this work aims to elucidate, firstly, what power is from its different perspectives and highlight a new structure that, breaking with the traditional cascade scheme (power-mandate-obedience), goes against the old paradigm, innovates relationships and materializes, inversely, the flow of underlying authority, always bearing in mind the elemental power-law relationship. Methodologically, the bibliographical review will briefly touch on the history of the municipality and converge on the Government-Public Administration duo, with special interest in territorially decentralized forms of government, such as the region, province or canton, in the case of Ecuador and State or municipality in the case of Venezuela, in whose management the presence of the universal principles of the Administration is assumed, as a social science. In other words, we will see the possibility of crystallizing the sovereign power of the people, within the scope of what has been modernly called New Latin American Constitutionalism.
dc.description.abstractPoder y derecho son dos caras de una misma moneda, la cual existe válidamente, si se ha acuñado de manera legítima y legal. En este marco, pretende este este trabajo, dilucidar en primera instancia, qué es el poder desde sus diferentes ópticas y resaltar una nueva estructura, que rompiendo con el esquema tradicional en cascada, de poder-mandato-obediencia, contraviene el viejo paradigma, innova las relaciones y materializa, de manera inversa, el flujo de autoridad subyacente, teniendo siempre presente la insalvable relación poder-derecho. Metodológicamente, la revisión bibliográfica tocará de manera tangencial la historia del municipio y convergerá en el tema integrado por la fórmula, Gobierno- Administración Pública, con especial interés en las formas de gobierno descentralizadas territorialmente, como son la región, la provincia o el cantón, para el caso de Ecuador y Estado o municipio para el caso de Venezuela, en cuyas gestiones se asume la presencia de los principios universales de la Administración, como ciencia social. En otras palabras, se verá la posibilidad de cristalizar el poder soberano del pueblo, en el ámbito de lo que modernamente se ha llamado, Nuevo Constitucionalismo Latinoamericano.
