Las implicaciones de la norma 1273 del 23 de julio 2018 en Colombia para los trabajadores independientes

Abstract

La presente investigación se realizó acerca del decreto 1273 del 23 de Julio de 2018 y las implicaciones que tiene esta norma para los trabajadores independientes. Como primera instancia se elaboró una línea del tiempo en la cual se evidencio los distintos cambios que han suscitado a lo largo de la historia en la seguridad social de Colombia, desde su origen hasta la actualidad y específicamente lo que se enfocan a los trabajadores independientes. También se analizó algunos artículos de la constitución política de Colombia y el Código Sustantivo del trabajo los cuales sirvieron de apoyo para despejar algunos conceptos inherentes al tema. Después de realizar esta exploración documental comenzamos analizar las implicaciones que tiene la norma tema de investigación para los trabajadores independientes, dando como resultado que a partir de la promulgación de la misma se tienen algunos beneficios en cuanto al tema de celebración de contratos y las personas que antes no podían alcanzar a un empleo por la obligación de realizar los pagos anticipados hoy lo puedan hacer. Se logró identificar que los trabajadores independientes son los que más deberían aportan al sistema de seguridad social en Colombia, pero son los que más evaden, y que esta situación es propiciada por el desconocimiento de la norma y la no promulgación de la misma por las entidades a cargo. Otro factor que incide en la omisión de los aportes es el mal funcionamiento que durante muchos años ha tenido el sistema y que por más reformas y normas que se elaboren no se ha podido lograr llegar al objetivo que es obtener la equidad social donde los colombianos se vean beneficiados, de una manera integral

This research was conducted on Decree 1273 of July 23, 2018 and the implications of this standard for independent workers. As a first instance, a timeline was elaborated in which the different changes that have evolved throughout Colombia's social security history, from its origin to the present and specifically thoste that focus on independent workers. Some articles of the political constitution of Colombia and the Substantive Labor Code were also analyzed, which served as support to clear some concepts inherent in the subject. After carrying out this documentary exploration, the implications of the standard research topic for independent workers were analized, resulting in the fact that since the promulgation of this legislation there are some benefits in terms of the issue of contracts so that people who could not reach a job before, because of the obligation to make advance payments, now they can do it. It was possible to identify that the independent workers are the ones who should contribute the most to the social security system in Colombia but they are the ones that evade the most, and that this situation is caused by the ignorance of the norm and the non-promulgation of the same by the responsible entities. Another factor that affects the omission of contributions is the malfunction that the system has had for many years and that even though reforms and norms have been elaborated, it has not been possible to reach the objective of obtaining social equity where Colombians gain benefits, in an integral way.
