En Colombia, nace el Sistema General de Seguridad Social Integral con la Ley 100 de 1993, bajo los principios de eficiencia, universalidad y solidaridad, buscando garantizar una calidad de vida acorde a la dignidad humana, mediante mecanismos de protección de derechos de los trabajadores ante contingencias que puedan afectarle. Un mecanismo de protección es la estabilidad laboral reforzada, que prohíbe a los empleadores terminar contratos sin que medie justa causa o permiso del Ministerio de Trabajo, ya que, sin el lleno de los requisitos legales, vulnera el derecho a la salud y el derecho al trabajo.
In Colombia, the Integral Social Security General System was born with the law 100 of
1993 under the principles of efficiency, universality and solidarity, seeking to guarantee a quality
of life in accordance with human dignity, through workers’ rights protection mechanisms in case
of contingencies that might affect them.
One protection mechanism is reinforced labor stability, which forbids employers from
terminating contracts without just cause or permission from the Ministry of Labor. Not fulfilling
these legal requirements violates the rights to health and work.
This research will analyze the protection that workers have in Colombia when protected by
a special health condition or manifest weakness.
